JUSTICE SATYAVRAT VERMA ORAL ORDER 02-08-2022 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363, 366(A), 380 and 34 of the Indian Penal Code read with Section 8 of the POCSO Act.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are similarly situated like Umesh Kumar who has been granted bail by order dated 02.08.2022 in Cr. Misc. No. 71880 of 2021 thus seeks anticipatory bail on behalf of the petitioners who are related to Rahul. Learned counsel for the petitioner further adopts the

Patna High Court CR. MISC. No.91 of 2022(3) dt.02-08-2022 2/2 submissions made by the learned counsel for the petitioner in Cr. Misc. No. 71880 of 2021.

Learned A.P.P. for the State and the learned counsel for the informant oppose the prayer for anticipatory bail of the petitioners but are not able to meet the submission of the learned counsel for the petitioners that victim has not taken the name of the petitioners in her statement under Section 164 Cr.P.C. Considering the submissions made by the learned counsel for the petitioners, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Parihar P.S. Case No. 144 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
