JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. One country made pistol along with two live cartridges are said to have been recovered from the conscious possession of the petitioner and on the basis of disclosure made by the petitioner fire arms and other articles were recovered from the house of co-accused Gurmukh Thakur. No doubt the petitioner carries criminal antecedent of nearby 9 cases but the petitioner is in jail custody since 16.1.2014 and the present case has been lodged only for the offences punishable under the Arms Act.
Considering the aforesaid facts as well as
Patna High Court Cr.Misc. No.46170 of 2015 (2) dt.01-10-2015 2/2 submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chiraiya P.S. Case No. 290 of 2013 to the satisfaction of Judicial Magistrate 1st Class, Sikrahana at Dhaka, Distt. East Champaran.
