JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-11-2022 Heard Mr. Ajay Kumar, learned counsel for the petitioner and Mr. Aditya Narayan Singh, learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Mahua P.S. Case No. 239 of 2020 registered for the offence punishable under Section 392 of the Indian Penal Code. This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 10.03.2022 passed in Cr. Misc. 31918 of 2021 with liberty to renew his prayer for grant of regular bail after three months.
The First Information Report is against unknown
Patna High Court CR. MISC. No.61124 of 2022(2) dt.16-11-2022 2/3 alleging therein that the informant was accosted by two unknown miscreants, who on the gun point, looted a sum of Rs.2,00,000/- from the informant.
Learned counsel for the petitioner submits that the name of the petitioner has transpired on the basis of his confessional statement. He further submits that no looted article and/or incriminating material has been recovered from possession of the petitioner. The petitioner is in custody since 4.8.2020 and similarly situated co-accused persons have been granted bail by this Court in Cr. Misc. Nos. 40034 of 2021 and 54271 of 2022 respectively. Taking into consideration the fact that the petitioner is in custody since 4.8.2020, this is second attempt for grant of bail on behalf of the petitioner and similarly situated co-accused persons have been granted bail by this Court, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial
