The petitioner apprehends his arrest in connection with Excise Case No. 114 of 2019 corresponding to P.R. No. 22 dated 15.07.2019 registered under Section 30(a) of the Bihar Excise Act.
The accusation is that on receiving secret information about storage of illicit liquor by the petitioner in village Paharpur, the informant along with other excise officials reached there. On search, 1264 litres of Indian made foreign liquors kept in different bottles were recovered from the house of Pankaj Gosai @ Pankaj Gosawami.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.58286 of 2019(2) dt.16-09-2019 2/2 petitioner was not apprehended at the spot nor any illicit liquor has been recovered from the house of the petitioner, as seized illicit liquor was recovered from the house of Pankaj Gosai @ Pankaj Gosawami.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) his with two sureties of the like amount each to the satisfaction of the learned Spl. Judge Excise, Muzaffarpur, in connection with Excise Case No. 114 of 2019 corresponding to P.R. No. 22/19 dated 15.07.2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
