JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 30.01.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is said to have assaulted the informant's brotherin-law by Khanti. Informant's brother-in-law sustained one injury on his head but the opinion regarding the aforesaid injury was kept reserved till receipt of x- ray report.

It appears that doctor found the injury of informant's brother-in-law grievous in nature.

Submission on behalf of the petitioner is that there is case and counter case between the parties and persons from both sides sustained injuries and taking note of the aforesaid fact, some coaccused have already been granted bail by the learned court below. No doubt, injured Rajesh Kumar who happens to be brother-in-law of the informant sustained grievous injury but the concerned doctor has specifically mentioned in his report dated

Patna High Court Cr.Misc. No.44847 of 2015 (3) dt.30-01-2016 8.7.2015 that x-ray report did not reflect any boney injury but even then the aforesaid doctor observed that injury sustained by the aforesaid injured was grievous in nature.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Teghra P.S. Case no. 175/2015.
