The petitioner has renewed her prayer for grant of bail in a case registered under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

The earlier application for bail of the petitioner was rejected vide order dated 22.4.2022 passed in Cr. Misc. no.65434 of 2021.

As per the prosecution case, 5 litres of country liquor and 100 litres of jawa mahua was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. She is in custody since 25.9.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted in the earlier order of rejection dated 22.4.2022 and the petitioner having remained in custody for more than 1 year since 25.9.2021, the Court directs the petitioner to be enlarged on bail in connection with Khizersarai P.S. Case no.24 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge of Excise Act, Gaya.
