ANJANA MISHRA ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is mother-in-law who apprehends her arrest in connection with a case registered for the offences punishable under Sections 304(B)/201/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the charge has been levelled under the aforementioned Sections of the Indian Penal Code against the father-in-law and mother-in-law of the deceased lady, but the same does not attract the provisions of aforesaid Sections. It is further submitted that the father-in-law of the deceased lady and husband of the present petitioner has been extended the privilege of anticipatory bail vide order dated 31.07.2015 passed in Cr. Misc. No. 22957 of 2015.
Considering the aforementioned facts and circumstances and also the fact that the petitioner is similarly placed to Debu Chaupal (father-in-law of the deceased lady) who has already been enlarged on
Patna High Court Cr.Misc. No.53200 of 2015 (5) dt.16-03-2016 P2/2 bail, let the petitioner Yogni Devi, in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Biraul, Benipur, Darbhanga in connection with Kusheswar Asthan P.S. Case No. 135/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
