1. Heard learned counsel for the petitioners as well as learned APP for the State.

2. The petitioners apprehend their arrest in connection with Mahua P.S. Case no.195/2025 registered under Sections 351, 352, 329,(3), 77, 78, 3(5) of the B.N.S. & 66 of the IT.

3. The allegation in the first information is that the petitioners, who are next door neighbor of the informant were making some obscene photographs of the informant viral, and there is a further allegation of asking the informant and also her mother-in-law for establishing a physical relationship.

Learned counsel for the petitioners submits at the outset that it would be evident from the first information report that the petitioners are next door neighbours and the very allegation of asking for sexual favours from the informant as also her mother-in-law, does not prima-facie seem to be plausible and believable. It has further submitted that so far as the Sections 77 and 78 B.N.S. are concerned, the same are bailable in nature and the allegation of making the photo viral does not get substantiated from the materials collected during the course of investigation and the bail rejection order which deals with the case also does not reflect any material. The petitioners undertake to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the facts and circumstances of the case and also considering that the petitioners are next door neighbours and the allegations of making photographs viral do not stand reflected from the material collected during course of investigation, let the above named petitioners who have no criminal antecedent, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in

Patna High Court CR. MISC. No.62646 of 2025(2) dt.15-09-2025 3/3 connection with Mahua P.S. Case no. 195/2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023, and subject to following conditions:- (a) That the petitioners would not in future disturb her family and if any such allegation is made in future against these petitioners, the learned Court concerned would have the liberty to cancel the bail bonds.
