JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-09-2016 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner namely Santosh Mochi is in custody in Khudaganj P.S. Case No.52 of 2016 under Sections 147, 148, 149, 341, 323, 353, 308, 506 of the Indian Penal Code. According to the prosecution case, when the informant and others had gone to the village of the accused persons the mob i.e. the villagers surrounded them and assaulted. The informant got injured. From perusal of the injury report, it appears that only simple injury has been caused and that the allegation against the villagers is omnibus. There is no specific allegation against any of the villager.
Patna High Court Cr.Misc. No.39024 of 2016 (2) dt.17-09-2016 In view of the above facts, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Singh, the learned Judicial Magistrate, 1st Class, Hilsa, Nalanda in connection with Khudaganj P.S. Case No.52 of 2016.
