JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sadar P.S. Case No. 191 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

From the FIR it appears that police raided the houses of several accused persons in connection with recovery of liquor and from the house of petitioner 111.750 litres of liquor were recovered.

Submission of learned counsel for the petitioner is that he was not present at the house and he has falsely been implicated in this case.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.58656 of 2019(2) dt.18-09-2019 2/2 anticipatory bail on the ground that recovery has been made from the house of the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit.

With the above observation, this application is dismissed.
