2. The petitioners have preferred this application for grant of regular bail in connection with Rudrapur P.S. Case No. 101 of 2024 dated 06.09.2024 registered for the offences punishable under sections 406, 420, 467, 468 and 120B of the Indian Penal Code.

As per the prosecution case, the petitioners and the co-accused persons made a false claim on the land of the informant on the basis of forged documents relating to settlement case no. 12447 of 2002 and in support of this allegation the informant claimed that he got an information under the RTI Act vide application no.111 dated 08.03.2021 to this effect that the said settlement case had not been registered and on that basis the FIR has been registered.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that in respect of the same land Ram Avtar Singh as well as Bhola Prasad has also instituted a title suit no. 82 of 2020 in the learned court below against the father of the informant and his other relatives, the said title suit is pending adjudication before the court below prior lodging the FIR, and the same was decreed, in favour of the petitioners regarding which the relevant documents have been filed with this petition (Annexure-P/3 series) and these documents are sufficient to falsify the allegation levelled in the FIR. The petitioners have no concern with the alleged occurrence. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since
Patna High Court CR. MISC. No.62175 of 2025(3) dt.17-09-2025 3/3 29.07.2025. The co-accused person has already been granted regular bail by this Court vide order dated 12.08.2025 passed in Cr. Misc. No. 56341 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Madhubani, in connection with Rudrapur P.S. Case No. 101 of 2024.
7. The application stands allowed.
