Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the first information report which was registered on 2.5.2013. However, in course of investigation, some witnesses claimed to have seen the petitioner participating in the alleged crime. The statement of the aforesaid witnesses was recorded on 25.11.2015 vide pars 34, 35 and 36 of the supplementary case diary.

Considering this aspect of the matter that the name of the petitioner came in this case near about after two years of the alleged occurrence, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Sitamarhi
