The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 307 and 498A/34 of the Indian Penal Code. The petitioner is the elder brother of the husband of the informant, who is in custody since 18.09.2014.
The prosecution case is that the informant was torturing by her husband since last five years and made an attempt to push her in the well. On 13.09.2014 the husband along with family members including the petitioner sprinkled kerosene oil and lit the fire.
It is submitted by learned counsel for the petitioner that the accusation of sprinkling kerosene oil and litting
Patna High Court Cr.Misc. No.48889 of 2015 (02) dt.22-06-2016 2/2 fire is omnibus and general against entire in-laws family including the petitioner causing injury to the informant and the infant child. During investigation it transpired that the in-laws extinguished the fire as the informant tried to commit suicide after some scuffle with her husband. It is further submitted that the injury report of the infant child has not been brought on record. Though, statement to that effect has not been made in the petition. Moreover, the trial has not commenced as yet.
Considering the omnibus and general nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur in connection with Dulhin Bazar P.S. Case No. 146 of 2014.
The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for three consecutive occasions.
