The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1B)a/25(1-A)25(1-AA)25(1-C)26(i)(ii) 35 of the Arms Act as well as under Section 30(a) of the Bihar Excise (Amendment) Act, 2016.

Fire arms were recovered from the possession of co-accused Sanjay Mandal. Name of this petitioner has transpired in the confessional statement of co-accused.

Submission is that the petitioner was not present at the place of occurrence.

Considering the criminal antecedent of the petitioner,

Patna High Court Cr.Misc. No.15079 of 2017 (2) dt.06-04-2017 as disclosed in paragraph 3 of the bail petition, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail in connection with Bariyarpur P.S. Case No.14 of 2017 pending in the court of learned C.J.M., Munger is rejected. (Birendra Kumar, J) Arvind/- U T
