Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhargama P.S. Case No. 115 of 2022, lodged under Sections 302, 201/34 of the Indian Penal Code.

As per allegation made in the F.I.R., 6 persons were made accused in this case on the charge of murder of the deceased.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that antecedent of petitioner is clean and he is in

Patna High Court CR. MISC. No.61233 of 2022(2) dt.24-02-2023 2/2 custody since 30.05.2022. He further submits that though case has been lodged under Section 302/34 of the Indian Penal Code but Police has filed charge sheet under under Section 306 of the Indian Penal Code and cause of death is due to suicide. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Araria in connection with Bhargama P.S. Case No. 115 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
