2. The petitioner is seeking regular bail in connection with Purnea Sadar P.S. Case No. 325 of 2024 for the offences punishable under Sections 356 and 379 of the Indian Penal Code.

As per prosecution case, while the informant was going to Purnea Court Station in the way, two persons on motorcycle came and snatched the mobile phone of the informant and started fleeing away but due to traffic, they could not flee from there and one person who was riding the motorcycle was apprehended by local people who disclosed the name as Rahul Kumar(petitioner) and disclosed the name of the

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from the conscious possession of the petitioner. The mobile phone of the informant was snatched by co-accused Deepak Kumar who succeeded in fleeing away from the alleged place of occurrence. Petitioner is a man of clean antecedent. He is under custody since 07.06.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Purnea Sadar P.S. Case No. 325 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. Before accepting the bail bonds of the petitioner,

No.66740 of 2024(2) dt.26-09-2024 3/3 learned court below shall verify the criminal antecedent of the petitioner and if it is found that petitioner is involved in any other case except the present one, the bail bonds of the petitioner will be cancelled by learned court below.
