JUSTICE PURNENDU SINGH ORAL ORDER 24-09-2024 Heard Mr. Pramod Mishra, learned counsel appearing on behalf of the petitioner and Mr. Prabhat Kumar Verma, along with Mr. Sanjay Kumar Ghosarvey, learned counsels appearing on behalf of the State.

2. The petitioner, in paragraph no. 1 of the present writ petition, has sought, inter alia, the following relief(s), which is reproduced hereinafter:- "i) A certiorari setting aside the office order No.267 dated 25.08.2012 contained in memo

Patna High Court CWJC No.12630 of 2013(7) dt.24-09-2024 2/2 No.6979 issued from the level of Respondent Chief of Administration, whereby and whereunder the petitioner has illegally and arbitrarily been inflicted with two punishments i.e. (1) Punishment of censor and (2) Nothing shall be paid for the period of suspension except subsistence allowance, while concluding the departmental proceeding initiated against this petitioner vide memo No.1442 dated 10.03.2011 on false, frivolous and concocted charges due to remaining on strike.

ii) A Mandamus commanding and directing the Respondents concerned to exonerate the petitioner from all charge considering the nature of allegation and facts and circumstances and allow him to discharge his duties regularly and sincerely without any punishment or blame.

iii) And/or any other relief or reliefs for which the petitioner is found entitled to in the facts and circumstances of this case."

3. Learned counsel appearing on behalf of the respondent/s informs that the petitioner has now retired and he is hardly affected by the punishment order, so far as, his pensionary benefits are concerned.

4. Considering the facts and information, the present writ petition requires no consideration. Accordingly, the present writ petition is consigned.
