JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 406,420, 468, 464, 504, 323 and 120B of the Indian Penal Code.

Allegation against the petitioner is that he is Branch Manager of Everlight Realcon Infrastructure Ltd., Chapra Branch. Informant has alleged that on assurance of much profit he deposited Rs. 4.5 lacs in the said company. Thereafter, the company was closed and money was defalcated by the accused persons.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Informant was also an agent of the company and he has lodged this case just to defend

Patna High Court Cr.Misc. No.16688 of 2017 (2) dt.12-04-2017 2/2 himself. It has also been submitted that one of the co-accused has been granted bail by this Hon'ble Court which is at Annexure-2 to this petition.

Heard learned A.P.P. also.

Having heard both sides and in view of the fact that petitioner is Branch Manager of the company, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected. However, petitioner is directed to surrender in the court below, i.e., learned Judicial Magistrate, Ist Class, Saran at Chapra, in connection with Bheldi P. S. Case no. 17 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court. Accordingly, this application stands disposed of.
