Petitioner seeks bail in connection with G.O. P.S. case no. 21 of 2016 registered for the offence punishable under Sections 47(a) and (f) of the Excise Act and New Excise Policy, 2015.
Allegedly, from the hut of the petitioner, 150 kg of jaggery and two litres of illicit country made liquor besides other articles were recovered on 29.07.2016 and since then, the petitioner is in custody.
In the facts and circumstances stated above considering the detention of the petitioner, now he is directed to be
Patna High Court Cr.Misc. No.42032 of 2016 (2) dt.22-10-2016 2/2 released on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with G.O. P.S. case no. 21 of 2016 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from the privilege of bail.
