1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Rajpur P.S. Case no.133 of 2023 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, two accused persons including the petitioner on a motorcycle were arrested and 70 litres of liquor was recovered.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession and he has been falsely implicated in the case. He is in custody since 20.7.2023 and similarly situated co-accused Raushan Kumar has been enlarged on bail vide order dated

Patna High Court CR. MISC. No.67278 of 2023(22) dt.19-10-2023 2/2 6.10.2023 passed in Cr. Misc. no.63162 of 2023. The petitioner has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 20.7.2023, grant of bail to the above mentioned co-accused Raushan Kumar and the petitioner having no antecedent under the Bihar Prohibition and Excise Act, 2016, the Court directs the petitioner to be enlarged on bail in connection with Rajpur P.S. Case no.133 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no.2-cum-Additional District and Sessions Judge, Rohtas at Sasaram.
