The petitioner Udit Narayan Jha apprehends his arrest in Patauna Bisfi P.S. Case No. 26 of 2014, registered for the offences punishable under Sections 498(A), 341, 323, 316, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner Udit Narayan Jha is that while the informant was living with her husband in Punjab, the petitioner use to live with her husband and in absence of her husband the petitioner is alleged to have compelled the informant to see blue films and wanted to establish physical relation. Learned counsel for the petitioner submits that the petitioner is cousin brother-in-law of the husband of the informant. All the allegations are false and concocted. Even the S.D.P.O.
Patna High Court Cr.Misc. No.1095 of 2015 (3) dt.13-01-2015 found the case false, so far as the allegation of abortion is concerned. Other accused persons except the husband have already been granted anticipatory bail by the learned Sessions Judge.
It appears that the informant made allegation implicating all the family members of her husband and the petitioner happens to be her cousin brother-in-law. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Patauna Bisfi P.S. Case No. 26 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
