JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2017 The petitioner is in custody since 03.02.2017 in connection with Mansi P.S. Case No. 251 of 2014, registered for offences punishable under Sections 467, 468, 470, 471, 420/34 Indian Penal Code.
Allegation against the petitioner is of cheating the informant and other villagers by taking Rs. 5700 from each person on the pretext that he will provide a grant of Rs. 50,000 to each person from a foreign institution.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner has clean antecedent and has been in judicial custody since 03.02.2017 and other co-accused having similar allegation, has already been granted bail by the court below itself.

Having heard both sides, from perusal of the impugned order, it appears that petitioner was absconding in this case and due to which charge-sheet was submitted after two years, as such, considering the conduct of the petitioner, I am not inclined to grant him the privilege of regular bail, at least, at this stage. His prayer for regular bail is, accordingly, rejected. However, petitioner may renew his prayer for bail in the court below itself after framing of charge in this case. Learned Trial Court is also directed to expedite the trial and try to conclude it as early as possible.
