The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 188, 353, 427, 447, 448, 436, 337 of the Indian Penal Code and 3/4 of Prevention of Damage to Public Property Act. The prosecution case is that the FIR named accused persons entered into the office of the electricity department, broken the door, type machine, furniture and other articles.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against mob. The mob was protesting against the highhandedness of the Member of Parliament and similarly situated accused has been
Patna High Court Cr.Misc. No.45334 of 2015 (2) dt.03-11-2015 2/2 granted anticipatory bail vide Cr. Misc. No. 35972 of 2014. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 179 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
