The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 504, 498(A) of the Indian Penal Code.

The accusation is of torture for non-fulfillment of the dowry demand and performing second marriage. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the complainant. The complainant is in habit of lodging

Patna High Court CR. MISC. No.66542 of 2023(3) dt.11-10-2023 2/2 cases against the petitioner and other family members and up-till now, the she has lodged many cases against the petitioner and his family members. The allegation of performing second marriage by the petitioner is absolutely false, as Priti Kumari, who is alleged to have married with the petitioner was called before learned Court below where she denied to have married with the petitioner. The petitioner is languishing in custody since 19.07.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Sasaram, Rohtas in connection with Complaint Case No. 27 of 2023.
