The petitioner Dara Bhuiyan seeks bail in Dhibra P.S. Case No. 17 of 2009, registered for the offences punishable under Sections 144, 149, 427, and 120B of the Indian Penal Code, Section 17of the C.L.A. Act and 3 of Prevention of Damage to Public Property Act.
The informant alleged that Maoists cut the road and thereby caused damage to the public property. The informant came to know the name of Maoists from the villagers. Learned counsel for the petitioner submits that there is no eye witness of the occurrence. Many persons named in the FIR have been enlarged on bail.
It appears that the name of the petitioner also appears
Patna High Court Cr.Misc. No.52195 of 2014 (2) dt.08-01-2015 in the FIR, but the informant knew the name from the villagers and has not alleged anything about the petitioner. Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Dhibra P.S.
