The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 302, 328/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The name of the petitioner has surfaced during supervision of the case. The petitioner is wife of the deceased. During investigation not even a single witness has supported the prosecution case so far as involvement of the petitioner is concerned in this case. The petitioner has clean antecedent.

In the aforesaid facts and circumstances of the case,

Patna High Court CR. MISC. No.58124 of 2019(3) dt.18-11-2019 2/2 let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-13th, Muzaffarpur, in connection with Aurai P.S. Case No. 49 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
