JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 20.8.2014 in a case registered for the offences punishable under Sections 419,420,467,468,471,354 and 504 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the funds allocated for Indiara Aawas scheme in favour of the informant was not allowed to be withdrawn and the same was given to one Gayatri Devi. The petitioner is not named in the FIR but his name subsequently sprang up as the person instrumental in getting transferred the fund in favour of Gayatri Devi.

It is submitted by the learned counsel for the petitioner that the petitioner is neither the authority involved in distributing

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikarahana at Motihari in connection with Phenhara P.S.
