The petitioner apprehends his arrest in Kuchaikote P.S. Case No. 58 of 2016 registered under Sections 25(1-b)a, 26, 35 of the Arms Act.

The informant got information that three persons were going on a motorcycle and they were armed with country made pistol. The informant intercepted the motorcycle but two persons managed to flee away. One Dipu Kumar Soni, who was apprehended on the spot, disclosed the names of Ravi Kumar Ram (the petitioner) and Guddu Ram. From the possession of the apprehended accused, arms and ammunitions were recovered. It is submitted that the petitioner was not apprehended on the spot and nothing has been recovered from the possession of the petitioner. It appears from perusal of the FIR itself that the

Patna High Court Cr.Misc. No.39980 of 2016 (2) dt.20-09-2016 2/2 petitioner was also accompanying Dipu Kumar Soni but he managed to flee away from the place of occurrence and from the possession of Dipu Kumar Soni country made pistol and cartridges were recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Kuchaikote P.S. Case No. 58 of 2016. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
