The petitioner seeks regular bail in connection with Ram Nagar PS case no. 402 of 2017 instituted for the offences punishable under Sections 366, 366(A), 379, 506/34 of Indian Penal Code.

The allegation is regarding the petitioner having kidnapped the victim girl for the purposes of marrying her. The learned counsel for the petitioner has submitted that a bare perusal of the statement made by the victim girl under Section 164 of Code of Criminal Procedure before the learned Magistrate would show that the victim girl and the petitioner had a love affair and they fled away in the year 2017 and were living as husband and wife after marrying

Infact, the victim girl has also stated that there is one child from the wedlock and she is bearing the second child of the petitioner herein. It is further submitted that the girl is not minor which is apparent from the prescription of the doctor annexed to the case diary, wherein her age has been stated as 20 years. The petitioner is stated to be having clean antecedent and is languishing in custody since 25.06.2019. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Bagaha (West Champaran) in connection with Ram Nagar PS case no. 402 of 2017.
