The petitioner apprehends his arrest in Sahebganj P.S. Case No. 214/15 registered under Sections 302/34 of the Indian Penal Code.
The informant alleged that his father was killed in the night of 19.08.2015 and, on search, his dead body was found. The informant suspected that Chandradeo Mahto, Mahadeo Mahto, Krishna Mahto, Rajdeo Kumar (the petitioner) and Hali Ram might have killed his father. It is submitted that save and except suspicion, there is no material against the petitioner. Similarly situated co-accused persons, namely, Mahadeo Mahto, Chandradeo Mahto and Krishna Mahto have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 16735 of 2016.

No.39989 of 2016 (2) dt.21-09-2016 2/2 Considering the facts that there appears no eye witness of the occurrence and only on the basis of suspicion, the name of the petitioner and other accused persons have surfaced and similarly situated three other accused persons have already been enlarged on anticipatory bail, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (West), Muzaffarpur in Sahebganj P.S. Case No. 214/15, G.R. No. 2111/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
