2. The petitioner apprehends his arrest in connection with Jokihat P.S. Case No.380 of 2022 dated 15.07.2022 for the offences punishable under Section 420 & 406/34 IPC and Section 7 of the Essential Commodities Act, pending in the Court of learned Sub-divisional Judicial Magistrate, Araria.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is accorded.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within six weeks from today and seeks

Patna High Court CR. MISC. No.71716 of 2023(3) dt.08-12-2023 2/2 regular bail, the learned Court below would pass order on the same day in accordance with law considering the fact that petitioner has deposited all the loss amount, which was not earlier deposited.
