Petitioner apprehends his arrest in connection with Araria (Bairgachhi) P.S. Case No.185 of 2016 for the offence registered under sections 302/34 of the Indian Penal Code. Petitioner happens to be agnate of the informant and informant expressed her suspicion against the petitioner on the basis of previous enmity. The case diary goes to show that family members of petitioner as well as deceased used to quarrel with each other. Moreover, except suspicion, there appears to be nothing against the petitioner. Although investigation against the petitioner and some others has been kept pending but considering the aforesaid facts and circumstances as well as submissions of the

Patna High Court Cr.Misc. No.40691 of 2016 (3) dt.21-11-2016 2/2 parties, let the petitioner above named, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Araria (Bairgachhi) P.S. Case no. 185 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
