2. The petitioner apprehends his arrest in connection with Murliganj P.S. Case No. 108 of 2023 registered under Sections 341, 323, 324, 379, 354-B, 325, 504 and 506/34 of the Indian Penal Code.
3. As per the F.I.R., this petitioner is said to have assaulted informant by means of Dabiya.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics. Further submission is that the First Information Report has been lodged after a delay of 2 days without explaining the reasonable
Patna High Court CR. MISC. No.68780 of 2024(2) dt.23-10-2024 2/2 cause of delay. The doctor has found the injury simple in nature. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail by contending that petitioner is named in the First Information Report with the allegation of assault.
6. Having considered the facts and circumstances of the case as well as the nature of injury, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Madhepura in connection with Murliganj P.S. Case No. 108 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
