2. The petitioner has preferred this application for grant of regular bail in connection with Supaul P.S. Case No. 85 of 2023 dated 08.02.2023 registered for the offence punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, four unknown miscreants boarded two motorcycles are alleged to have stopped the informant and snatched Rs. 50,000/- in cash and a mobile phone on the point of gun and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner

Patna High Court CR. MISC. No.67411 of 2024(2) dt.21-09-2024 2/2 has sprung up in the confessional statement of the co-accused, Mithliesh Kumar and Anmol Yadav. Nothing has been recovered from the possession of the petitioner. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 06..04.2024. The co-accused has been granted anticipatory bail by this Court vide order dated 23.01.2024 passed in Cr. Misc. No. 79396 of 2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 85 of 2023.

7. The application stands allowed.
