2. Petitioner apprehends arrest in connection with Narpatganj P.S. Case No. 417 of 2023 registered for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act, 2016.

3. Learned counsel for the petitioner submits that the alleged motorcycle upon which Nepali liquor was said to be recovered does not belong to the petitioner and the petitioner has no concern with the alleged liquor seized by the police. He further submits that the petitioner has otherwise no criminal antecedent and has been falsely been implicated in the instant case.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of learned Special Judge, Excise-I, Araria in connection with Narpatganj P.S. Case No. 417 of 2023 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
