JUSTICE SUDHIR SINGH ORAL ORDER 09-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506, 379 and 34 of the Indian Penal Code.
Allegation against the petitioners is that they assaulted informant's father, son and brother with farsa, rod and stick and also snatched away golden ear ring and chain. It is submitted on behalf of the petitioners that they have got no criminal antecedent. It is a case and counter case between the parties. Both sides have received injuries. Injuries received on the part of the petitioners have not been explained by the informant which creates serious doubt upon the conduct of the prosecution. There is admitted land dispute between the parties. Petitioner nos. 3, 5 and 6 are ladies.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Patna High Court Cr.Misc. No.46812 of 2015 (2) dt.09-02-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Umesh Kumar Sharma, learned Addl. Chief Judicial Magistrate-II, Katihar, in connection with Mansahi P.S. Case no. 64 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
