2. The petitioner is praying for regular bail in a case registered for the offence punishable under Sections 25(1-b) a/26/35 of the Arms Act and 3/4 of the Explosive Substance Act.
3. The case of the prosecution is that from the possession of the petitioner, one automatic pistol and a magazine containing five live cartridges were recovered.
4. It has been submitted by the learned counsel for the petitioner that from perusal of the seizure list it transpired that one Dilip Kumar Singh is the witness of the seizure list and the petitioner is having enmity with Dilip Kumar Singh. To substantiate the facts, learned counsel has annexed the
Patna High Court CR. MISC. No.69929 of 2024(2) dt.08-10-2024 2/2 complaint petition which has been filed by Dilip Kumar Singh against this petitioner. Petitioner is having criminal antecedent of three cases.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Azamnagar P.S. Case No.201 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar.
7. Accordingly, the present bail application stands allowed.
