Petitioners apprehend their arrest in Mahua (Vaishali) P.S. Case No.283 of 2019 registered under Sections 363 and 365 of the Indian Penal Code.
The informant disclosed that his minor daughter went to withdraw amount from State Bank C.S.P. but she did not return. During course of search, the informant came to know that Sohan Das kidnapped his minor daughter. It is further alleged that when the informant went to the house of Sohan Das, his parents and other relatives abused and assaulted the informant.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.58556 of 2019(2) dt.20-09-2019 2/2 allegation of kidnapping is against Sohan Das. The petitioners are father, mother, brother and sister-in-law of Sohan Das. Nobody has seen the petitioners kidnapping the victim. The petitioners have been made accused in the case only because they happen to be close relatives of Sohan Das, but Sohan Das is already in jail.
Having considered the facts and the nature of allegation made against the petitioners and the fact that the petitioners are father, mother, brother and sister-in-law of Sohan Das, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Mahua (Vaishali) P.S. Case No.283 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U T
