JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Bodhgaya P.S. Case No. 195 of 2019 registered for the offences punishable under Sections 406, 420, 504, 506 and 34 of the Indian Penal Code.
Prosecution case is that one Suresh Paswan, son of petitioner No.1, has taken Rs.3.20 lac for execution of sale deed with respect to a piece of land but he has not executed sale deed on one plea or the other and further it is alleged that he executed a power of attorney also, as such he cheated the informant. Submission of learned counsel for the petitioners is that there is no allegation against these petitioners of taking
Patna High Court CR. MISC. No.58017 of 2019(2) dt.13-09-2019 2/2 amount from the informant and on power of attorney there is no signature of any of the petitioners and whatever allegation is there that is against Suresh Paswan, son of petitioner No.1 and not against the petitioners.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioners.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Bodhgaya P.S. Case No. 195 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
