JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 25-02-2016 By way of the present application preferred under Articles 226 and 227 of the Constitution of India, the petitioner seeks quashing of the first information report (for short "the Act") of Vigilance P. S. Case No. 69 of 2013 corresponding to Special Case No. 40 of 2013 registered under Sections 409 and 120-B of the Indian Penal Code as also Section 13(2) read with 13(1) (e) of Prevention of Corruption Act, 1988.

I have heard learned counsel for the petitioner, learned counsel for the State, learned counsel for Vigilance and

Patna High Court Cr. WJC No.1016 of 2015 dt.25-02-2016 2/2 perused the FIR as contained in Annexure-1 to the present application. The allegations made therein do attract ingredients of a cognizable offence.

In that view of the matter, the application, being devoid of any merit, is hereby dismissed.
