JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 16-12-2015 Petitioner apprehends his arrest in a case under section 323, 341, 324, 307, 504, 379/34 of the Indian Penal Code. The petitioner submits that he and his relatives have been falsely implicated in this case on account of previous case filed against the informant being Parsa P.S. Case No. 163/14. He next submits that offence took place because of land disputes and both sides are close relatives. He further submits that there is no allegation of commission of theft against him. Learned counsel for the State submits that the petitioner assaulted the father of the informant Lal Bahadur Singh who sustained lacerated wound over the nose upto left eyes 1" x 1⁄2" x skin deep, and the injured was even hospitalized in the PMCH.

Patna High Court Cr.Misc. No.49621 of 2015 (3) dt.16-12-2015 2/2 Having considered the submission of the parties, the prayer for bail of the petitioner in Parsa P S. Case No. 123 of 2015 is rejected with direction to surrender and seek regular bail which would be considered on its own merit. With the aforesaid observations, this application stands disposed of.
