The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner is of assaulted the sister of the informant by causing death.

Learned counsel for the petitioner submits that both parties are close relatives and have land dispute between them. The petitioner is in custody since 02.05.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No. 60793 of 2019(3) dt.06-02-2020 2/2 bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Darbhanga, in connection with Kamtaul P.S. Case No. 61 of 2019, subject to the following condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
