1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302, 120B of the Indian Penal Code & Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case. It is next submitted that Sikandar Kumar @ Shukardhan along with three others had moved this court seeking anticipatory bail by filing Cr. Misc. No.23968 of 2024 and the same was allowed by an order dated 22.08.2024. It is submitted that the case of the petitioner is akin to the case of Sikandar Kumar and three others, thus seeks anticipatory bail on parity. It is also submitted that while granting the privilege of anticipatory bail to Sikandar Kumar
Patna High Court CR. MISC. No.65729 of 2024(2) dt.25-10-2024 2/2 and three others, the court had dealt the case on merits in detail.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner but is not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner and also taking into considerations the order dated 22.08.2024 in Cr. Misc. No.23968 of 2024, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Agamkuan P.S. Case No.1077 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
