The learned counsel for the petitioners submitted that he may be permitted to withdraw this anticipatory bail application regarding petitioner No.1, Sanjay Jaiswal, 2. Manoj Jaiswal and 3. Daya Jaiswal as they have already been arrested. Permission is accorded. Accordingly, this Criminal Miscellaneous application is dismissed against them. So far petitioner No.4, Hanuman Jaiswal is concerned, he apprehends his arrest in Mohania P.S. Case No. 362
Patna High Court Cr.Misc. No.41858 of 2016 (2) dt.06-10-2016 of 2016 under Sections 418, 419 420, 384, 120(B), 34 of the Indian Penal Code.
Learned counsel for the petitioner submitted that in similarly situated case, the co-accused, Jaswant Singh, has already been granted anticipatory bail in Cr. Misc. No. 41612 of 2016 and the case of the petitioner is on same footing . Considering the facts and circumstances of the case, I direct the petitioner, above named, to surrender before the court below within one month from today and on his so surrendering, the court below shall release the petitioner on furnishing bail bond of Rs. 5,000/- (five thousand only) with two sureties each of the like amount to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Mohania P.S. Case No. 362 of 2016 subject to the condition as laid down under Section 438(2) Cr.P.C. Brajesh/- (Mungeshwar Sahoo, J) U T
