The petitioner is apprehending his arrest in connection with Patahi P.S. Case No. 56 of 2015 for the offences instituted under Sections 147, 148, 149, 452, 341, 323, 380, 427, 353, 504 and 506 of the IPC.
The prosecution story, in brief, is that on 21.04.2015 at around 8 hours, the police official alongwith armed force of Patahi P.S. came to the informant and told for making identification of one Bidhyanand Mahto, S/O Ruplal Mahto of Village- Pansalwa whereby the informant proceeded alongwith police official to the house of said Bidhyanand Mahto and reached to the house of
Patna High Court Cr.Misc. No.46810 of 2015 (3) dt.01-02-2016 2/3 Bidhyanand Mahto, made quarry from his relative about Bidhyanand Mahto. His son Bhagwan Kumar appeared before the police official and told about him to have standing towards Kudi Pokhar. The police official went there made investigation and get return back.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused in the present case due to village politics. General and omnibus allegation has been made. No specific role has been assigned against the petitioner. The other co-accused have been granted anticipatory bail by this Court vide Cr. Misc. No. 30150/2015.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R. alongwith 50-60 unknown persons.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Patahi P.S. Case No. 56/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikarhana, Motihari, East Champaran, subject to
Patna High Court Cr.Misc. No.46810 of 2015 (3) dt.01-02-2016 3/3 the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
