JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 06/03/2014 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. It is a case of road robbery and the name of the petitioner surfaced in the confessional statement of co-accused. It is submitted by learned counsel for the petitioner that neither any recovery has been made from his possession nor the petitioner was put on T.I. parade. Moreover, co accused Santosh Manjhi has been granted bail vide order dated 09/05/2012 in Cr. Misc. No. 11330 of 2012. The petitioner is accused in five other cases. Statement to this effect has been made in para 3 of the petition.
Patna High Court Cr.Misc. No.1447 of 2015 (2) dt.19-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000./- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-II., Nawadah in S.Tr.No. 256 of 2014/ 137 of 2014 arising out of Hisua P.S.Case No. 152/2011. The court below will be at liberty to cancel the bail bonds of the petitioner if he gets substantially involved in some serious nature of offence or defaults for two consecutive occasions.
