The petitioner seeks pre-arrest bail in connection with Bhaptiyahi P.S. Case No. 119 of 2018, pending in the Court of the Chief Judicial Magistrate, Supaul, registered under Sections 379, 411 and 34 of the Indian Penal Code.

The accusation is that at about 01.00 p.m. on 07.11.2018, two persons started to carry the motorcycle from the house of the informant, Ashok Mehta. On sound, informant woke up and raised alarm and villagers also reached there and started chasing both the thieves. At short distance, one of the was caught hold, who disclosed his name Shashi Bhushan Mukhiya and also disclosed the name of co-accused, who succeeded to flee away, as Ranjit Mukhiya. Thereafter, the police was informed, Shashi Bhushan Mukhiya and theft

Patna High Court CR. MISC. No.62380 of 2019(2) dt.16-10-2019 2/2 motorcycle were handed over to police.

Having regard to the facts and circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for prearrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
