JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-04-2024 The present writ petition has been filed seeking the following reliefs:- "i) For quashing the order dated 08.11.2021 passed by learned Court of Commissioner, Tirhut Division, Muzaffarpur in I.C.D.S. Appeal Case No. 02/2021 whereby the learned Court without application of mind, in perfunctory manner rejected the appeal filed by the petitioner.

Patna High Court CWJC No.21409 of 2021(2) dt.03-04-2024 2/3 II) For quashing the order dated 09.10.2020 passed by learned Court of District Programme Officer, Muzaffarpur whereby the learned Court without considering the report of Circle Officer, Saraiya, Anchal, Muzaffarpur and without considering the guidelines of 2019 issued for selection of Anganwadi Sevika/Sahaika in rural and urban projects of Bihar State under Integrated Child Development Services, rejected the claim of the petitioner for appointment to the post of Anganwadi Sevika.

III) For directing the respondent authorities to make appointment to the petitioner on the post of Anganwadi Sevika considering the report of Circle Officer, Saraiya Anchal, report of Mukhiya, Panchayat Secretary and ward member of ward no.-10 of Gram Panchayat Raj Bahilwara Govind under Saraiya Block, District of Muzaffarpur and also considering that she has been placed at Sl. No. 1 in the merit list as per other norms of the guidelines 2019."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies

Patna High Court CWJC No.21409 of 2021(2) dt.03-04-2024 3/3 as are otherwise available under the law, including that of filing a civil suit before the learned civil court of competent jurisdiction. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
