JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has already returned to her home safely and her statement has been recorded under section 164 of the Cr.P.C. The victim stated in her statement that she was forcibly taken away by five persons including petitioner and she was made captive in a room where she was assaulted by the petitioner and his associates and on the very next day, she was dropped by the petitioner and others near Amba Asthan and from where, she came to her home. Except assault, no ill-treatment was done towards her by the petitioner and his associates. The victim disclosed her age as 15 years but the Medical Board found her age between 16 to 17 years.
Patna High Court Cr.Misc. No.41202 of 2016 (3) dt.04-10-2016 2/2 No doubt, police has submitted charge sheet under sections 363, 366A, 376G/34 of the Indian Penal Code but taking note of the statement of the victim as well as facts and circumstances of the case and also keeping in mind that petitioner is in jail custody since 28.05.2013 and the investigation against the petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Aurangabad in connection with Simra P.S.Case No. 08 of 2013 (Hemant Kumar Srivastava, J) N.K/- U T
