JUSTICE RAKESH KUMAR ORAL ORDER 05-12-2016 Heard Sri Anurag Saurabh, learned counsel, who was assisted by Sri Dharmendra Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 01.05.2016 in Asarganj P.S. Case No.28/2016 registered for the offence under Sections 20/ 22 of the N.D.P.S. Act, has prayed for grant of bail.
Learned counsel for the petitioner submits that the petitioner is having clean antecedent and has been victimized by the police. He further submits that falsely he has been implicated in the present case, whereas on perusal of the F.I.R., it is evident that on secret information that the petitioner is indulged in trafficking of ganja, a raid was conducted and on search, from the house of the petitioner, 25 kg of Ganja was recovered in presence
Patna High Court Cr.Misc. No.41619 of 2016 (2) dt.05-12-2016 2/2 of petitioner.
Keeping in view the nature of accusation, I am not inclined to extend the privilege of bail. The petition stands dismissed.
